Who operates this service

PenaltyFreeRetire is operated by Alphashift (Pty) Ltd, trading as Moolman Institute, a private company registered in South Africa under registration number 2016/495773/07. In these terms, "PenaltyFreeRetire," "we," "us," and "our" refer to that company.

Agreement to these terms

These terms govern your use of PenaltyFreeRetire.com, including its calculators, educational content, optional accounts, saved scenarios, and emailed resources. By using the service, you agree to these terms. Account creation requires an affirmative acceptance of the version in effect at that time. If you do not agree, do not create an account or continue using the service.

Eligibility

You must be at least 18 years old to create an account or submit your email to request resources or marketing updates. The service is not directed to children. A parent or guardian should supervise any other use by a minor.

Educational service only

The site provides free retirement calculators and educational material. It does not provide tax, legal, investment, accounting, or financial advice and does not create a professional or fiduciary relationship. Laws, tax rules, plan terms, market conditions, and individual circumstances change. Results are estimates based on your inputs and simplified assumptions. Before acting on a material decision, verify the relevant facts and consult an appropriately qualified professional.

Accounts and security

Accounts are optional. You must provide accurate information, protect your password and access credentials, and tell us promptly if you suspect unauthorized access. You are responsible for activity through your account unless applicable law provides otherwise. You may stop using the service at any time and may request account deletion through our contact form. Limited security, legal, or email-suppression records may be retained where reasonably necessary or required by law.

Saved scenarios

You may save scenarios with an account or with a random browser identifier. Anonymous saves are not linked to your name or email, but they are stored on our servers and are pseudonymous rather than purely local. Clearing the relevant cookie may permanently remove your access to those saves. Anonymous scenarios are deleted 12 months after their most recent update and should not be treated as permanent records. Keep your own copy of any information you need to preserve.

Acceptable use

You may use the service for lawful personal purposes. You may not:

  • disrupt, overload, probe, or circumvent the service or its security;
  • use automated means to scrape the service in a way that harms it or violates law;
  • submit unlawful, deceptive, infringing, or abusive material;
  • impersonate another person or misuse another person's account; or
  • use the service to build or operate a competing commercial product without permission.

Intellectual property and feedback

The service's code, design, branding, calculators, and original content belong to us or our licensors. We grant you a limited, revocable, non-transferable right to use the service for personal, non-commercial purposes and to share public pages through ordinary or built-in sharing features with attribution. If you voluntarily send feedback or suggestions, you give us a nonexclusive, worldwide, royalty-free licence to use that feedback to improve and promote the service. This licence does not transfer ownership of your personal information or private saved scenarios.

Third-party services and links

The service relies on providers including Supabase, Resend, Google, Sanity, and Vercel, and may link to sites such as IRS.gov. Their terms, privacy practices, outages, and content may affect your experience. We do not control external sites, but this clause does not remove any responsibility that applicable law places on us for our own provider choices or processing. Availability and warranties

To the maximum extent permitted by law, the service is provided "as is" and "as available." We do not promise uninterrupted availability or that every calculation or item of content will be complete, current, or suitable for your circumstances. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, exemplary, or consequential loss, or for lost profits, data, opportunities, or tax benefits arising from use of the service. Our total direct liability arising from the service is limited to the greater of the fees you paid us for the service during the 12 months before the event giving rise to the claim or US$100.

These limits do not apply to fraud, wilful misconduct, gross negligence, or any liability or consumer right that applicable law does not permit us to limit or exclude.

Suspension and termination

We may proportionately restrict or suspend access where reasonably necessary to address abuse, security threats, unlawful conduct, provider disruption, or a legal requirement. You may stop using the service at any time. Provisions concerning intellectual property, disclaimers, liability, disputes, and accrued rights survive to the extent their nature requires.

Changes to these terms

We may update these terms prospectively. We will update the effective date and, for a material change affecting registered users, provide reasonable notice by account email or a prominent site notice before the change takes effect. Changes do not retroactively reduce rights already accrued, and any mandatory notice or consent requirement under applicable law still applies.

Governing law and disputes

These terms are governed by South African law. Subject to any nonwaivable right to use another forum, the courts with jurisdiction in the Western Cape, South Africa, have jurisdiction over disputes. These terms do not require arbitration and do not include a class-action waiver. Mandatory consumer and privacy rights in your home jurisdiction remain available to you.

General terms

If a provision is unenforceable, it will be limited or removed only to the extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. These terms, together with the Privacy Policy and any additional terms shown for a specific feature, form the agreement governing the service.

We may send service or legal notices to your account email or post a prominent notice on the site. Those notices are separate from optional marketing consent.
